Terms and conditions for renting motorcycles and booking Moto-Moto tours

Definition of terms
By accessing and using the website www.moto-moto.ro, provided by RIDEWITHME SAFE SRL, you agree to the following terms and conditions. Please read them carefully. If you do not agree, please leave this site. These terms and conditions may be revised later without notice.
The website is operated by our company RIDEWITHME SAFE SRL, and the activity consists in renting motorcycles and organizing motorcycle tours on the territory of Romania, as a result of reservations made on the website www.moto-moto.ro (hereinafter Moto-Moto).
We will consider the reservation valid when the form filled in with the personal data of the participant is signed and sent together with the proof of the bank deposit to the e-mail address: contact@moto-moto.ro. All costs mentioned below are entered in Euro currency, but payment will be made in lei at the BNR exchange rate on the day of payment. Please read the sections described below carefully.
Conditions for booking a Moto-Moto tour
The organization of our motorcycle tours, described below, will be done in collaboration with a tour-operating company, which will provide the tourist packages including accommodation, meals, etc., namely GEORGE TURISM SRL, with its registered office in the municipality of Cluj-Napoca, Alexandru str. Ciurea, no. 2, ap. 4, Cluj county, Romania, registered at the Trade Registry Office next to the Cluj Court under no. J12/1771/2005, having VAT no. RO 17572406, holder of the tourism license issued by the Ministry of Tourism no. 1642/02.04.2019.
To validate the reservation, after submitting the form, a payment of 30% is required in advance. This amount will be deducted from the total cost at the time of final payment.
Each Moto-Moto tour has a limited number of participants. We will reserve these places in order of requests received and advance payment respectively. Moto-Moto provides for every tour of at least 7 days, a roadside assistance car that will collect all the luggage.
A maximum of 60 days before the departure date, the final payment related to the tour will be made. If the final payment for the tour has not been made a maximum of 60 days before the start of the tour, Moto-Moto reserves its right to cancel the reservation and will keep the initial deposit of 30%. Each participant will sign a waiver/liability agreement prior to the start of the tour, without which they cannot participate in the tour. Through this agreement, it will be declared that each participant is personally responsible for any damage caused/suffered during the tour.
Moto-Moto undertakes to provide services according to the tour description and local standards. However, in situations related to external factors such as: road repair works, hotels closed without notice, unfavorable weather conditions, or other aspects that cannot be foreseen or controlled by Moto-Moto or that fall under the cases of Major force, Moto-Moto reserves its right to change the route of the tour and to inform the participants as soon as possible.
All tour participants will sign a declaration stating that Moto-Moto is not responsible for the safety of the participants and their belongings and cannot be held responsible for any incidents that may lead to injury, accidents or even death of the participants during the tour, the partial or total destruction of their property or that of their companions.
Also, Moto-Moto is not responsible for any damages caused by accidents involving third-party road users during the tour. Moto-Moto is not responsible for any lost or stolen goods during the tour.
Moto-Moto employees, tour guides, support car drivers or other agents are representatives of the company but are not parties to the contract signed between Moto-Moto and the participant.
All tour participants are required to obey local traffic laws. If a tour participant does not obey the traffic rules in force, Moto-Moto reserves the right to unilaterally terminate the contract, without notice and without court intervention, and to automatically withdraw the rented motorcycle. Each participant is responsible for all fines received during the tour. All participants also undertake not to adversely affect nature or the surrounding environment during Moto-Moto rentals or tours.
No alcohol, drugs or other psychoactive substances will be consumed during the entire ride on the motorcycle. Each participant on the tour or renting a motorcycle needs a valid driver's license according to the category for driving a motorcycle.
For motorcyclists traveling alone, upon request, if available, there is the option of single or double room accommodation, together with another tour participant.
Any other activity complementary to the motorcycle tour (swimming, mountain hiking, other activities in nature) is the responsibility of the tourist, without implying Moto-Moto's liability in any way.
Moto-Moto requires that each participant on the tour or renting a motorcycle takes appropriate measures for their own protection, wears the appropriate equipment and takes out travel insurance and health insurance, and optionally luggage insurance or other types of insurance .
All photos or videos produced by Moto-Moto are the property of Moto-Moto. Moto-Moto may also use these materials for advertising purposes, including images in which participants can be recognized. In this regard, before participating in the tour, each participant will obligatorily sign a document in which he gives his consent to the processing of his personal data, including name, surname, personal image, etc. and which will allow you to publish photos on social networks or websites belonging to Moto-Moto, for advertising/marketing purposes. In addition, entrants who submit photos or videos to Moto-Moto will state that they consent to their use as necessary for advertising or marketing purposes.
Moto-Moto is not responsible for any loss or damage to tour participants' luggage. Baggage will be personally handed over each day to the driver of the assistance car. It is also recommended to take out luggage insurance.
Moto-Moto makes every effort to schedule tours when weather conditions are optimal. However, especially in high mountain areas the weather can be changeable and the weather conditions can change from one hour to another, and Moto-Moto cannot be responsible for this fact. Moto-Moto reserves its right to change the route in case of bad weather, as well as in case of road maintenance work or other changes in safety conditions that may occur and influence the smooth running of the tour. Moto-Moto is therefore not responsible for unfavorable weather conditions or other changes that may occur due to unattributable causes, and the cost paid for participation will not be refunded in this case.
Participants are obliged to notify Moto-Moto, at least 10 days before the day of the start of the tour, regarding the request for special dietary regimes (vegans, food intolerances, allergies), for.
Use of your own motorcycle during the tour
If a motorcyclist uses his own motorcycle on the Moto-Moto tours, he is responsible and guarantees the condition of his vehicle. It must correspond from a technical and legal point of view. If, due to a breakdown or other event, the motorcyclist cannot continue the route, he is responsible and will bear any additional costs arising from the recovery, transport or repair of the motorcycle. Also, the participant must prove that an insurance policy has been concluded within the validity period. At the same time, if the motorcyclist cannot continue the route due to a breakdown or any other reason, Moto-Moto is under no obligation to change the route or tour plan. In this case, Moto-Moto can provide, for an additional cost, everything necessary for the recovery, transport or repair of the motorcycle.
Canceling a Tour
In the event that a customer cancels the reservation, after the reservation has been confirmed, Moto-Moto reserves the right to refund the initial deposit as follows:
1. Cancellation more than 60 days in advance - Moto-Moto will refund 100% of the tour cost
2. Cancellation between 59 - 30 days before - Moto-Moto will refund 60% of the tour cost
3. Cancellation between 29 - 15 days before - Moto-Moto will refund 30% of the tour cost
4. Cancellation within 14 – 0 days prior - No refunds
No exceptions to these terms will be made under any circumstances. We also inform you that you are required to take out a Trip Cancellation Insurance.
Moto-Moto can cancel a tour up to two weeks before the start of the tour if the minimum number of participants is not reached. In this case Moto-Moto will notify the participants and return 100% of the deposit originally submitted by them.
Moto-Moto is not responsible for other expenses advanced by tour participants such as: (airline tickets, hotel reservations, etc.).
About motorcycles
Moto-Moto offers you BMW R1250 GS motorcycles. The pictures on the website or on other advertising materials are for informational purposes only and do not necessarily represent the exact version of the motorcycles made available. Moto-Moto will make every effort to make the requested model available to the applicant but, in case of unavailability, reserves the right to offer a comparable model.
All Moto-Moto motorcycles have compulsory insurance and full Casco insurance. In the event of an incident involving the motorcycle or in the event of the motorcyclist's inability to continue, the rental period is not suspended. During the rental period, Moto-Moto has no obligation to replace a damaged motorcycle.
At the same time, if a participant uses his own motorcycle and it is damaged during the tour, Moto-Moto has no obligation to provide him with another motorcycle.
Moto-Moto will require a deductible deposit of €1500 at the start of each rental. This deposit will be held as a guarantee until the motorcycle is returned in the same condition as it was received at the time of rental.
Full Casco Insurance is included in the motorcycle rental price.
If you want to make a reservation more than 30 days before the actual rental, Moto-Moto will request an advance of 30% of the total rental value, but not less than 150 euros, to ensure motorcycle rental. The reservation is finalized when the amount has been collected by Moto-Moto in the bank account specified on the tax invoice. If an applicant does not submit the deposit within 3 days, Moto-Moto may cancel the reservation without any notice.
If the applicant cancels the reservation less than 30 days before the actual reservation, Moto-Moto will return 50% of the advance received. In case of cancellation less than 15 days before the actual rental, Moto-Moto will not return the amounts paid as an advance. Changes can be made to the selected period up to 21 days before the reservation, without Moto-Moto requesting additional costs.
Each rental motorcycle will be delivered with a full tank and will also be returned with a full tank. Otherwise, a fee of 25 euros will be requested. Each user of the rental motorcycles will use the equipment with care and attention and observe any computer warnings it identifies on the display.
We also recommend that every user make sure that they follow the traffic rules. All fines incurred by a motorcyclist while using a Moto-Moto motorcycle are exclusively his responsibility and will be paid by him.
Moto-Moto will always hand over motorcycles in good working order and safety. Along with the motorcycle, Moto-Moto will hand over its documents and keys to the person who rents it. At the time of handing over the motorcycle, a report will be drawn up that will certify the condition of the motorcycle and in which any bumps or damaged parts will be reported.
The person renting the motorcycle may under no circumstances:
- allows the use of the motorcycle by another person who is not authorized or who is not a party to the rental agreement

to drive the motorcycle if his driver's license is suspended
- to drive the motorcycle if he is not in a minimum necessary physical condition (fatigue, weakness or other similar situations)
- to drive the motorcycle under the influence of alcohol or other psychoactive substances
- participate in competitions or contests of any kind
- to use the motorcycle off-road (exceptionally, only under the supervision of Moto-Moto staff)
In case of an accident or road event in which the motorcycle is involved, the person who rented the motorcycle is obliged to call the Moto-Moto team urgently, at the number specified in the contract. Any repairs to the motorcycle will only be done with the consent of Moto-Moto. In case of an accident with victims, the Police must be notified.
The person renting the motorcycle also understands that, although the motorcycles are insured, they are still liable for damages in the following situations:
- Leave the scene of the accident
- Causes damage intentionally or through gross negligence
- I exceed the duration of the rental agreement
In addition, regardless of the chosen insurance option, the renter is fully liable in the following situations:
- Any damage caused to the motorcycle when the rider is under the influence of alcohol, drugs or any other substance that may affect his ability to drive
- Any damage caused intentionally or through gross negligence
- For any damage caused by a person other than those specified in the rental contract
- For any damage caused to the Wireless Cradle system
- A fee of 80 euros will be paid for the loss of documents
- A fee of 200 euros will be paid for the loss of the keys
Damage to motorcycles
The renter is responsible for any damage caused to the motorcycle, documents, accessories that may occur during the rental. This includes but is not limited to: theft or loss, damages caused by accidents or errors of use, or other damages that lead to a decrease in the value of the motorcycle.
By the term DAMAGE we agree that we will exclude situations where the motorcycle is affected by minor stains caused by insects or pebbles which are considered normal. Damage caused by falls or other accidents or scratches caused by using the motorcycle in thick vegetation or bushes is not considered normal.
The person renting the motorcycle is responsible for the cost of transporting the motorcycle damaged through his fault, until the service agreed by Moto-Moto.
Responsibility
Moto-Moto cannot be held responsible in the event that a tour cannot be organized for reasons such as: riots, floods, earthquakes, war or other force majeure situations.
All tour participants are aware of the risks and dangers and will accept the liability clauses.
It is also accepted by all parties involved that Moto-Moto is not responsible for the individual or collective safety of tour participants or motorcyclists renting motorcycles Moto-Moto, activity that can lead to injury, death or other physical or other harm.
Moto-moto is not responsible for the loss or destruction of goods left behind or similar situations during the tour or rental.
Intellectual property rights
All copyrights, trademarks and any other intellectual property rights in all texts, images or other materials on this website are the property of RIDEWITHME SAFE SRL or its affiliates/collaborators. No material on this site can be reproduced in part, in whole or modified without the express consent expressed by RIDEWITHME SAFE SRL or by the holder of this right.
All rights are reserved to RIDEWITHME SAFE SRL. It is strictly forbidden to use this site for the purpose of destroying or altering it, its content or its security, or for discrediting or harassing RIDEWITHME SAFE SRL or its affiliates/collaborators. RIDEWITHME SAFE SRL will take all technical and organizational security measures to protect the data over which it has control, against any situation of accidental or intentional manipulation, loss, destruction or against access by an unauthorized person. Also, RIDEWITHME SAFE SRL will actively exercise its intellectual property rights in all aspects protected by law.
You may use our Services only for lawful purposes. You may not use the website in any way that violates any applicable law or regulation. You also agree not to access without authority, interfere with, cause damage or interrupt any part of the website, or any network or equipment used by RIDEWITHME SAFE SRL, in the provision of our services.
Changes to terms and conditions
Changes to these terms and conditions that will appear along the way will be published on this web page without informing you. RIDEWITHME SAFE SRL reserves the right to revise and update these rules at any time, without notice or prior acceptance of users.
Full agreement
Law and Jurisdiction
These Terms and Conditions of Use are governed by Romanian law, and the Romanian courts at the headquarters of the Moto-Moto provider will have the jurisdiction to resolve any dispute, having as its object claims arising from or regarding any use of our Services.
